The Commission will be separate from the Department of Education, Culture and Sports and attached to the Office of the President for administrative purposes only.It will cover both public and private institutions of higher education as well as degree-granting programs in all post-secondary educational institutions.
The successors of the Commissioners will have to be appointed and qualified.If a member of the Commission fails to complete his term, his successor will be appointed by the President but only for the unexpired portion.
Two additional members of the Board of Advisers may be appointed by the President.
Development plans, policies, priorities, and programs for higher education and research are recommended.
Priority and grants on higher education and research should be recommended to the executive and legislative branches.
Minimum standards for programs and institutions of higher learning should be set by panels of experts in the field and subject to public hearing.
Monitor and evaluate the performance of programs and institutions of higher learning for appropriate incentives as well as the imposition of sanctions such as, but not limited to, diminution or withdrawal of subsidy.
Potential centers of excellence should be identified and supported for the development of world-class scholarship, nation building and national development.
The budgets of public institutions of higher learning as well as general guidelines for the use of their income should be recommended to the Department of Budget and Management.
Setting standards, policies and guidelines for the creation of new ones as well as the conversion or elevation of schools to institutions of higher learning is subject to budgetary limitations and the number of institutions in the province or region.
Developing criteria for allocating additional resources such as research and program development grants, scholarships, and other similar programs will not detract from the fiscal autonomy already enjoyed by colleges and universities.
It is possible for institutions of higher learning to conduct research to meet the needs of agriculture and development.
Section 10 hereunder states that the Higher Education Development Fund will promote the purposes of higher education.
Review the charters of institutions of higher learning and state universities and colleges, including the chairmanship and membership of their governing bodies, and recommend appropriate measures as basis for necessary action.
In order to carry out the purpose and objectives of the Act, it is necessary to promulgate rules and regulations.
For its effective operations and for the continued enhancement, growth or development of higher education, it may be necessary to perform other functions.
The members of the staff will be appointed by the commission.

A.Government financing institutions identified and requested by the Commission may contribute an amount equivalent to 3% of their unimpaired surplus realized in the preceding year, but not more than 5%.
The private portion of the Fund will be raised from donations, gifts, and other conveyances.
The necessary guidelines for its use will be prepared by the Commission as administrator of the Fund.
A.Overhead expenses for administration will not be covered by the seed capital of the Fund.
A.Unless otherwise stipulated by the private donor, only earnings of private contributions shall be used for administrative expenses.
A separate staff, independent administratively and budgetarily separate from the Commission secretariat, shall be appointed and organized by the commission.
The degree-granting programs of the Bureau of Technical-Vocational Education, including those for higher and tertiary education, are equivalent to the appropriations for the current year.
There will be no loss of rank or seniority for regular or permanent employees who are transferred to the Commission.The Bureau of Higher Education personnel who are not transferred to the Commission will be given all the benefits they are entitled to under existing laws, rules and regulations.
The Commission will have jurisdiction over post-secondary degree-granting programs and tertiary institutions.
The Secretary of Education, Culture and Sports (DECS), Chair of the Senate committee on education, arts and culture, and a representative from the Association of Christian Schools and Colleges will form a temporary body.
The complete and full operation of the Commission will not be later than three (3) months after the effectivity of this Act.The rules and regulations needed to effectively implement the smooth and orderly transfer to the Commission will be promulgated.The transition period will begin from the approval of this Act.
